2b. Dark Humour & Satire Disclaimer
⚠️ This is a dark humour platform.
TomPearl.com and ScaTube are intentionally provocative, absurdist, and satirical communities. Content on this platform — including video titles, thumbnails, descriptions, and usernames — frequently uses extreme, offensive, or shocking language as a form of dark comedy and internet troll culture.
Video titles do not necessarily describe the actual content of the video. Provocative or extreme-sounding titles are a recognized form of dark humour and shock satire common in internet culture. They are not statements of real beliefs, endorsements of violence, or descriptions of actual events.
Content that appears offensive in isolation should be understood in the context of this platform's satirical and community-driven nature. In no case does content published here reflect the genuine beliefs, opinions, or intent of the platform operators.
What is allowed vs. what gets filtered — concrete examples:
- ✓ ALLOWED: "Jeffrey Epstein liked kids" — this is a documented fact about a convicted criminal. Stating factual public record about a public figure, including in a dark or ironic tone, is protected commentary and satire. Courts, journalists, and comedians have always been able to state true things about convicted criminals.
- ✓ ALLOWED: "Epstein didn't kill himself", "Epstein Island memes", conspiracy jokes, dark humour about public criminal cases — all legal satire on matters of public record.
- ✗ FILTERED: "raping kids haha" — even as a "joke", writing CSAM-adjacent language in comments is strategically harmful to the platform. It doesn't matter if the intent is comedic: it exposes the site to legal liability, gets picked up by automated scanners, and gives complainants ammunition. Our text filter replaces these terms with *** automatically.
- ✗ FILTERED: Terms like r4pe, r.a.p.e, p3do — leet speak and punctuation bypass attempts are detected and censored the same as the full word.
The line: Referencing facts about criminals = satire and journalism. Writing out CSAM-adjacent acts even "as a joke" = filtered. One is social commentary; the other is a liability with no comedic upside.

3. Strictly Prohibited Content
The following content is absolutely forbidden and will result in immediate removal, permanent ban, and where applicable, reporting to law enforcement:

- Gore & graphic violence: Real-world footage of death, mutilation, torture, or extreme physical violence.
- Non-consensual intimate content (NCII): Revenge porn or leaked private sexual content posted without the subject's consent.
- Doxxing: Publishing private personal information (home address, phone number, postal code, financial data, or workplace) of private individuals without consent. This includes name + address combinations targeting private persons.
- Incitement to suicide or self-harm: Content directly instructing, encouraging, or glorifying suicide or self-harm directed at a specific individual (e.g. "kill yourself", "hang yourself").
- Incitement to violence: Content calling for or glorifying real-world violence against specific individuals or groups.
- Malware / phishing: Links or files designed to compromise users' devices or steal credentials.
- Impersonation: Falsely claiming to be law enforcement, government agencies, or other platforms.
- AI-generated CSAM / deepfakes of minors: Synthetic, AI-generated, or digitally altered sexual content involving minors is treated identically to real CSAM under applicable law.
⚠️ CSAM Reporting Obligation (REPORT Act 2024): This platform is legally required under US federal law (18 U.S.C. § 2258A, as expanded by the REPORT Act, Pub. L. 118-78, enacted 2024) to report any discovered child sexual abuse material to the NCMEC CyberTipline. Failure to report can result in fines of up to $150,000 (first offense) or $300,000 (subsequent offenses). All CSAM-related evidence is preserved for a minimum of one year. Automated detection tools are in place and all reports are acted upon immediately.

5. Adult Content Policy
TomPearl.com / ScaTube permits adult (18+) content under the following conditions:
- All individuals depicted must be 18 years of age or older. No exceptions.
- Content must involve consenting adults. Non-consensual content is prohibited.
- By uploading adult content, you confirm that all persons depicted are adults and that you have verified their age.
- Adult content must not depict real violence, torture, or content violating Section 3.
- The platform operator reserves the right to remove any adult content at their sole discretion.
6. Upload Rules
- Maximum 3 uploads per IP per hour. Abuse results in permanent ban.
- Accepted formats: MP4, MOV, AVI, MKV.
- All uploads are subject to automated content scanning (PhotoDNA for CSAM, AI gore detection).
- Flagged uploads are automatically hidden pending manual review.
- Duplicate content (detected via file hash) will be rejected.
- Uploading content you do not own may result in a DMCA takedown.
- A watermark (tompearl.com) is automatically applied to all uploaded videos.
7. User Accounts
- You must be 18 years or older to create an account.
- One account per person. Multi-accounting to evade bans is prohibited.
- You are responsible for all activity under your account.
- Accounts posting prohibited content will be permanently banned without warning.
- We reserve the right to terminate any account at any time for any reason.

9. Enforcement & Moderation
Automated systems
- PhotoDNA — scans all uploads against the NCMEC database of known CSAM
- AI content scanning — detects gore and graphic violence on video frames
- Rate limiting — prevents spam and flood uploads
- Auto-ban — IPs triggering flood or injection attempts are automatically banned

Platform operators review all flagged content. Moderation decisions are final with no formal appeals process.

10. Automated Text Filter
All user-generated text (comments, testimonials, feedback) is processed through an automated content filter before being displayed publicly. This filter operates in real-time and applies the following protections:
- CSAM & minor-related terms — words referencing sexual content involving minors are replaced with

- Sexual violence — terms such as rape, grooming, trafficking are censored in public display.
- Zoophilia / necrophilia — related terminology is filtered.
- Suicide incitement — phrases directly instructing users to harm themselves are censored.
- Doxxing & private information — street addresses (number + street type), phone numbers, and postal codes are automatically detected and replaced with

- Owner privacy — the platform operator's real name is protected and will never appear in public comments.
Note: The original text is stored securely in our database and is accessible only to platform administrators for moderation review. The censored version is what is shown publicly. Bypass attempts (leet speak, repeated characters, punctuation between letters) are detected and filtered automatically.
